Welcome to Shot Drop. The terms “we,” “us,” and “our” refer to Shot Drop. We operate this website and store, including all related information, content, features, tools, products, and services (the “Services”). Shot Drop is powered by Shopify.
These Terms of Service (the “Terms”) describe your rights and responsibilities when you use the Services. By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

SECTION 1 - ACCESS AND ACCOUNT

You represent that you are at least the age of majority in your state or province of residence and you consent to any minor dependents using the Services on devices you manage. You may be asked for information such as email, billing, payment, and shipping details. You confirm all information you provide is accurate and you have the right to provide it. You are responsible for keeping your account secure and for all activity on it.

SECTION 2 - OUR PRODUCTS

We try to display products accurately, but colors and appearance can vary by device. Product descriptions may change without notice. We may limit quantities or discontinue products at any time.

SECTION 3 - PREORDERS AND ORDERS

When you place an order, you make an offer to purchase. We may accept or decline any order at our discretion. Payment is processed at the time of order for preorders and in-stock items.
Preorders. Preorder items are not yet in stock. Estimated delivery dates are shown at checkout and may change. If we make a material change, we will contact you using the email or phone you provided.
Cancellations. We may be unable to cancel orders after acceptance. If we must cancel all or part of an order, we will notify you and issue a refund for the cancelled items.
Your purchases are subject to our Refund Policy.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotions may change without notice. The price charged is the price at the time of order and will appear in your confirmation email. Taxes, shipping, handling, customs, and import charges are extra unless stated otherwise. You agree to keep your payment information current and authorize us to charge your payment method for your order total.

SECTION 5 - SHIPPING AND DELIVERY

Delivery times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, or events outside our control. Title and risk of loss pass to you when the order is transferred to the carrier. Shipping policies are described in our Shipping Policy.

SECTION 6 - AGE AND SAFETY NOTICE

Shot Drop is a bar accessory. By purchasing, you confirm you are of legal drinking age in your jurisdiction and you will use the product responsibly. Follow all instructions and safety guidance. Do not use with chipped or cracked glassware. We are not responsible for injury or damage resulting from misuse or failure to follow instructions.

SECTION 7 - INTELLECTUAL PROPERTY

All content on the Services, including names, logos, text, images, and designs, is owned by Shot Drop or its licensors and protected by law. You may use the Services for personal, non-commercial use only. Do not copy, distribute, modify, or create derivative works without our written permission. Shopify and other third-party names and logos are trademarks of their owners.

SECTION 8 - OPTIONAL TOOLS

We may provide access to third-party tools “as is” and “as available” without warranties or endorsements. Your use of such tools is at your own risk and subject to the third party’s terms.

SECTION 9 - THIRD-PARTY LINKS

The Services may link to third-party websites or include third-party functionality. We are not responsible for their content, policies, or practices. Review their terms and privacy policies before engaging in any transaction.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

[Do not remove or modify this section.] Shot Drop is powered by Shopify, which enables the Services. Purchases are made from Shot Drop, not Shopify. Shopify is not responsible for your sales with Shot Drop. You release Shopify and its affiliates from claims related to your purchases and transactions with Shot Drop.

Personal information we collect is subject to our Privacy Policy. Because the Services are hosted by Shopify, Shopify also collects and processes personal information to operate and improve the Services. See Shopify’s privacy policy for details.

SECTION 12 - FEEDBACK

If you submit reviews, ideas, or suggestions (“Feedback”), you grant us a worldwide, sublicensable, royalty-free license to use and display that Feedback to operate and improve the Services and our products. You confirm you have rights to the Feedback and that it complies with these Terms.

SECTION 13 - ERRORS, INACCURACIES, AND OMISSIONS

Information on the Services may contain errors or omissions, including in product descriptions, pricing, promotions, shipping charges, transit times, and availability. We may correct or update information or cancel orders if information is inaccurate at any time without prior notice.

You may use the Services only for lawful purposes. Prohibited activities include violating laws, infringing intellectual property rights, harassing others, submitting false information, uploading malware, scraping, spamming, and attempting to bypass security. We may suspend or terminate access for violations.

To the fullest extent allowed by law, Shot Drop and its affiliates, officers, employees, agents, contractors, service providers, and licensors are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, savings, data, or replacement costs arising from your use of the Services or products. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

SECTION 18 - INDEMNIFICATION

You agree to indemnify and hold harmless Shot Drop, Shopify, and their affiliates and personnel from claims and expenses arising out of your breach of these Terms, violation of law, or misuse of the Services.

SECTION 19 - SEVERABILITY

If any provision of these Terms is found unlawful or unenforceable, the remainder remains in effect.

SECTION 20 - WAIVER; ENTIRE AGREEMENT

A failure to enforce a right is not a waiver. These Terms and policies referenced here are the entire agreement between you and us regarding the Services.

SECTION 21 - ASSIGNMENT

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without notice.

SECTION 22 - GOVERNING LAW

These Terms and any related dispute are governed by the laws of the State of New York, without regard to conflict of law rules. You consent to exclusive jurisdiction and venue in the state and federal courts located in New York County, New York.

SECTION 23 - CHANGES TO TERMS OF SERVICE

We may update these Terms by posting a new version on this page. Material changes will be notified as required by law. Your continued use of the Services after changes are posted means you accept the new Terms.
